If you do not agree, do not use or access the Services.

• You must be at least 13 years old or the minimum age required by law in your jurisdiction, whichever is higher.
• Children under 13 must use the Services with parental or guardian consent and supervision.
• You confirm that you have the legal authority to enter into this agreement.

• To use certain Services, you must create an account with your accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your login credentials.
• Any activity under your account is your sole responsibility.
• You must notify us immediately of any unauthorized use.

• You may not reverse engineer, modify, or create derivative works of our Services.
• You may not use the Services to develop competing products.
• Automated access, scraping, or systematic downloading is strictly prohibited without prior written permission.
• We reserve the right to suspend or terminate your access at any time for any reason.

5.1 Ownership

All intellectual property rights in our Services remain with FORMAS.AI. Users retain ownership of the content they create.

5.2 License to FORMAS.AI

• By submitting or generating content on our Services, you grant FORMAS.AI a revocable, non-exclusive license to use, process, store, and display your content solely to deliver and maintain the Services.
• FORMAS.AI may publicly display content from Free and Basic Plans in our community gallery or showcases, with attribution.
• Pro, Education, and Enterprise Plans content remains private unless you give explicit written permission.

5.3 Prohibited Content

You warrant that any content you provide:

• Does not infringe third-party intellectual property or privacy rights.
• Does not contain harmful, obscene, hateful, or unlawful material.
• Does not violate any applicable law or regulation.

We may remove or disable access to any content that violates these Terms or is reported, without notice.

• Free and Basic Plans: You retain ownership of generated images and designs, but FORMAS.AI may display them publicly with attribution.
• Pro, Education, and Enterprise Plans: All generated content is private. FORMAS.AI will never share or use it for training or public display without your explicit written consent.

You may use your generated content for personal, academic, or commercial purposes, subject to this agreement and applicable law.

• We do not use your Pro, Education, or Enterprise plan data for model training or AI improvement without your explicit consent.
• Free plan content may be anonymized and used internally to enhance Services.

• You may terminate your account at any time.
• FORMAS.AI may suspend or terminate your access for violations of these Terms, non-payment, or illegal or harmful conduct.

Upon termination, your data will be handled according to our Privacy Policy.

• Your use of personal data is governed by our Privacy Policy.
• We employ industry-standard safeguards for data security.
• International data transfers comply with applicable laws.

• Services are provided “as-is” and without warranties of any kind.
• FORMAS.AI holds no liability for data loss, service interruptions, or third-party content.
• We are not liable for indirect, consequential, or incidental damages unless caused by gross negligence or willful misconduct.

You agree to indemnify FORMAS.AI, its affiliates, and their personnel against any claims arising from your use of the Services, your content, or breach of these Terms.

These Terms are governed by the laws of the Republic of Singapore.

Disputes will be resolved through arbitration under the rules of the Singapore International Arbitration Centre (SIAC), unless individual disputes are pursued in small claims court.

We may update these Terms to reflect changes in our Services, laws, or business practices.
